Pemberian Thr Kepada Pimpinan Dan Pegawai Non Pns Pada Forum Nonstruktural (Lns)


Salam semangat buat rekan semuanya. Alhamdulillah, hari ini kita telah memasuki puasa yang ke-enam di Bulan Suci Ramadhan 1440 H. Semoga kita selalu diberikan keberkahan oleh Allah SWT dalam melakukan Puasa Ramadhan ini Aamiin. Postingan kali ini admin akan membagikan isu mengenai Pemberian Tunjangan Hari Raya (THR) kepada Pimpinan dan Pegawai Non Pegawai Negeri Sipil (PNS) pada Lembaga Nonstruktural (LNS)  yang tertuang dalam Peraturan Pemerintah Republik Indonsia Nomor 37 Tahun 2019.


Berdasarkan Peraturan Pemerintah (PP) Nomor 37 Tahun 2019, dinyatakan bekerjsama Pimpinan dan Pegawai Non Pegawai Negeri Sipil (Non PNS) pada forum LNS diberikan Tunjangan Hari Raya (THR). 

Adapun yang dimaksud dengan Lembaga Nonstruktural (LNS) yaitu forum selain kementerian atau selain forum pemerintah nonkementerian yang dibuat dengan Undag-undang, Peraturan Pemerintah, atau Peraturan Presiden yang pembiayaannya dibebankan kepada Anggaran Pendapatan dan Belanja Negara. Hari raya yang dimaksud yaitu Hari Raya Idul Fitri.
 

 hari ini kita telah memasuki puasa yang ke Pemberian THR Kepada Pimpinan dan Pegawai NON PNS pada Lembaga Nonstruktural (LNS)


Pimpinan pada LNS yang berhak mendapatkan Tunjangan Hari Raya (THR) terdiri atas :

- Ketua / Kepala ;
- Wakil ketua / Wakil kepala ;
- Sekretaris ; dan / atau 
- Anggtoa 


Seperti yang telah dijelaskan pada Pasal 2 PP Nomor 37 Tahun 2019,  Pimpinan dan Pegawai Non Pegawai Negeri Sipil pada LNS yang berhak mendapatkan Tunjangan Hari Raya (THR) harus memenuhi persyaratan sebagai berikut :

- Warga Negeri Indonesia (WNI) ;
- Telah melakukan kiprah pokok organisasi secara penuh dan terus-menerus paling singkat selama 1 (satu) tahun semenjak pengangkatan / penandatanganan perjanjian kerja pada LNS yang bersangkutan ; dan
- Pendanaan belanja pegawainya dibebankan kepada Anggaran Pendapatan dan Belanja Negara ; dan 
- Diangkat oleh pejabat yang mempunyai kewenangan atau telah menandatangani Sura Perjanjian Kerja sesuai dengan ketentuan yang berlaku pada LNS. 


Besaran THR yang didapatkan oleh Pimpinan dan Pegawai Non PNS pada LNS :

Besaran THR yang didapatkan telah dijelaskan pada Pasal 4 dalam PP Nomor 37 Tahun 2019, menyerupai berikut ini:

1. Tunjangan Hari Raya (THR) sebagaimana dimaksud dalam Pasal 2 yaitu diberikan sebesar penghasilan 1 (Satu) bulan pada 2 (dua) bulan sebelum bulan Hari Raya sesuai dengan ketentuan peraturan perundang-undangan yang mengatur mengenai penghasilan bagi pimpinan dan pegawai non pegawai negeri sipil pada LNS ;

2. Dalam hal penghasilan sebagaimana dimaksud pada ayat (1) lebih besar dari besaran penghasilan sebagaimana tercantum dalam Lampiran Peraturan Pemerintah ini maka Tunjangan Hari Raya diberikan sebesar penghasilan sesuai besar penghasilan dalam lampiran ;

3. Dalm hal penghasilan 1 (satu) bulan pada 2 (dua) bulan sebelum bulan Hari Raya sebagaimana dimaksud pada ayat (1) lebih kecil dari besaran penghasilan sebagaimana tercantum dalam Lampiran Peraturan Pemerintah ini maka Tunjangan Hari Raya dibayarkan sebesar penghasilan 1 (Satu) bulan pada 2 (dua) bulan sebelum bulan Hari Raya ;

4. Besaran penghasilan Tunjangan Hari Raya dalam lampiran merupakan bab tidak terpisahkan dari Peraturan Pemerintah ini. 


Barangkali menjadi pertanyaan buat rekan semuanya, kapan Tunjangan Hari Raya dibayarkan ? 

Pembayaran Tunjangan Hari Raya kepada Pimpinan dan Pegawai Non Pegawai Negeri Sipil pada LNS telah dijelaskan pada Pasal 5 PP Nomor 37 Tahun 2019, sebagai berikut :

1. Tunjangan Hari Raya dibayarkan paling cepat 10 (sepuluh) hari kerja sebelum tanggal Hari Raya ;

2. Dalam hal Tunjangan Hari Raya sebagaimana dimaksud pada ayat (1) belum sanggup dibayarkan, Tunjangan Hari Raya sanggup dibayarkan sesudah tanggal Hari Raya.
